COMMENT, The charge as it is made by Council is based on the SPIN put on their own adopted policy.

In addition to putting this spin on the adopted policy, Council ignores the provisions of the Statutory Guidelines on this charge, including that the charge should reflect actual costs, be fair and be comparable to the residential charge.
Council has said that the giudelines are "merely guidelines" even though it is a Statutory Document created under sect 409/6 of the Local Goverment Act.
The guidelines require compliance with under the National Competion Policy which is also considered irrelevant by Council.
Should Council in the long run, get away with this RORT will it set a precedent in law? That is the question and crux of the matter
